These Terms and Conditions set out the terms on which Bright Bee Tutors provides and facilitates online tutoring services.

 

Please read these Terms and Conditions carefully before booking a tutoring lesson with Bright Bee Tutors. By booking or using our tutoring services, you confirm that you have read, understood and agreed to these Terms and Conditions.

 

These Terms and Conditions should be read alongside our Data Protection and Privacy Policy, Lesson Recording and Privacy Policy, Safeguarding and Child Protection Policy and Cancellation & Rescheduling Policy  which form part of the arrangements governing our services.

 

1. About Bright Bee Tutors

1.1. Bright Bee Tutors provides and facilitates online tutoring services by connecting students and their parents or guardians with independent tutors.

1.2. Our tutors provide tutoring in subjects and educational levels stated on their individual profiles.

1.3. Bright Bee Tutors does not guarantee that a particular tutor, subject, qualification, grade or lesson time will always be available.

1.4. Tutor availability is subject to change and a suitable alternative tutor may be offered where appropriate.

2. Definitions

For the purposes of these Terms:

"Bright Bee Tutors", "we", "us" or "our" means Bright Bee Tutors.

"Tutor" means an individual tutor introduced, engaged or facilitated by Bright Bee Tutors to provide tutoring services.

"Parent/Guardian" means the parent, legal guardian or other person responsible for arranging tutoring for a student under the age of 18.

"Student" means the individual receiving tutoring services.

"Customer" means the person responsible for booking and/or paying for tutoring services, whether this is the Student or their Parent/Guardian.

"Tutoring Services" means the online educational tutoring provided by a Tutor through arrangements facilitated by Bright Bee Tutors.

"Lesson" means an individual online tutoring session booked with a Tutor.

 

3. Booking Tutoring Services

3.1. A tutoring arrangement is formed once Bright Bee Tutors has confirmed the booking and the relevant lesson details have been agreed.

3.2. Before lessons commence, the Customer will be informed of the relevant Tutor, subject, lesson duration, frequency and tutoring fee.

3.3. Tutors may set their own tutoring fees, subject to agreement with Bright Bee Tutors and the Customer before lessons commence.

3.4. The agreed tutoring fee will be confirmed before the first lesson.

3.5. A Customer is not required to continue tutoring indefinitely and may end an ongoing tutoring arrangement in accordance with our Cancellation & Rescheduling Policy and these Terms.

3.6. Bright Bee Tutors may recommend an alternative Tutor where a Tutor is unavailable, unsuitable for the Student's requirements or unable to continue providing lessons.

 

4. Tutor Selection and Vetting

4.1. Bright Bee Tutors takes reasonable steps to assess Tutors before allowing them to provide tutoring services through Bright Bee Tutors.

4.2. Before tutoring students, Tutors are required to provide satisfactory evidence of their identity, right to work in the UK and an appropriate DBS certificate where required or appropriate to the role.

4.3. Where requested, Tutors may also be required to provide evidence of relevant qualifications, experience, references or other information relevant to their suitability.

4.4. Tutor profiles may include information relating to qualifications, educational background, relevant experience, subjects taught and other information supplied by the Tutor.

4.5. While Bright Bee Tutors takes reasonable steps to assess Tutors, no recruitment or vetting process can guarantee that a Tutor will be suitable for every individual Student.

4.6. We will consider the Student's age, subject requirements, learning needs and other relevant information when recommending a Tutor where reasonably possible.

4.7. Tutors may have different levels and types of experience. A Tutor profile will not necessarily indicate that the Tutor has previously taught students through Bright Bee Tutors.

 

5. Our Tutoring Services

5.1. Tutoring is provided online using the agreed video-conferencing or online learning platform.

5.2. The Customer is responsible for ensuring that the Student has suitable equipment, internet access and a suitable environment in which to participate in lessons.

5.3. Tutors will provide lessons with reasonable care and skill and will make reasonable efforts to adapt teaching to the Student's stated educational needs.

5.4. Tutoring is intended to support a Student's learning and educational development. Bright Bee Tutors does not guarantee a particular examination grade, academic result or improvement in performance.

5.5. Students remain responsible for completing their own schoolwork, revision and examinations.

5.6. Tutors will not knowingly assist Students with cheating, plagiarism or other forms of academic misconduct.

 

6. Payments and Fees

6.1. The tutoring fee will be agreed with the Customer before lessons commence.

6.2. The Customer is responsible for paying the agreed tutoring fee for each lesson booked.

6.3. Unless otherwise agreed in writing, payment must be made using the payment method specified by Bright Bee Tutors.

6.4. Bright Bee Tutors operates a fee-sharing model. For each tutoring lesson successfully paid for through Bright Bee Tutors, 80% of the tutoring fee actually received will be paid to the Tutor and 20% will be retained by Bright Bee Tutors as our fee for facilitating and administering the tutoring arrangement.

6.5. The 20% Bright Bee Tutors fee covers services including, where applicable, Tutor recruitment and vetting, safeguarding procedures, administration, matching Students with Tutors, payment administration, customer support and the operation and development of Bright Bee Tutors.

6.6. Bright Bee Tutors will confirm the tutoring price payable before the Customer commits to lessons.

6.7. We reserve the right to change tutoring fees for future lessons. Any change will be communicated to the Customer before the changed price applies.

6.8. If a payment is overdue, Bright Bee Tutors may suspend future lessons until the outstanding amount has been paid.

6.9. Nothing in these Terms affects any statutory rights the Customer may have under applicable consumer law.

 

7. Cancellations, Rescheduling and Missed Lessons

7.1. Cancellations, rescheduling, missed lessons and applicable charges are governed by our Cancellation & Rescheduling Policy, which forms part of these Terms and Conditions.

 

8. Recording of Online Lessons

8.1  Online tutoring lessons may be recorded for safeguarding, quality assurance and other legitimate purposes. Further information regarding lesson recording, consent, access and retention is set out in our Lesson Recording & Retention Policy and Data Protection & Privacy Policy, which form part of these Terms and Conditions.

 

9. Safeguarding and Child Protection

9.1. The safety and welfare of Students is a priority for Bright Bee Tutors. Our tutoring services are provided in accordance with our Safeguarding & Child Protection Policy, which sets out our safeguarding procedures and responsibilities.

 

10. Student and Customer Responsibilities

10.1. The Customer agrees to provide accurate and up-to-date information when arranging tutoring.

10.2. The Customer must inform Bright Bee Tutors and/or the Tutor of any information that may reasonably affect the safe or effective delivery of tutoring.

10.3. Students are expected to behave respectfully towards Tutors.

10.4. Customers and Students must not engage in threatening, abusive, discriminatory, harassing or inappropriate behaviour towards Tutors or Bright Bee Tutors staff.

10.5. Customers must not use tutoring sessions for any unlawful purpose.

10.6. Parents/Guardians remain responsible for ensuring that appropriate arrangements are in place for the Student before, during and after an online lesson.

10.7. For younger Students, Parents/Guardians should remain appropriately available during the lesson where reasonably necessary to support the Student's safety and wellbeing.

 

11. Communication Between Customers and Tutors

11.1. Bright Bee Tutors may provide contact information to Tutors and Customers where reasonably necessary to facilitate tutoring.

11.2. Customers and Tutors must use contact information responsibly and only for purposes connected with the tutoring arrangement.

11.3. Customers must not request or encourage a Tutor to provide tutoring services outside of Bright Bee Tutors where doing so would circumvent Bright Bee Tutors' agreed fees or arrangements.

11.4. Tutors must not independently arrange payment or tutoring services with a Student or Parent/Guardian introduced through Bright Bee Tutors in a manner intended to circumvent Bright Bee Tutors.

11.5. Any concerns regarding communication between a Tutor and Customer should be reported to Bright Bee Tutors.

 

12. Data Protection and Privacy

12.1. Bright Bee Tutors collects and processes personal information in accordance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018.

12.2. Our Data Protection and Privacy Policy explains what personal information we collect, why we collect it, how it is used, who it may be shared with and how long it is retained.

12.3. Customers should read our Data Protection and Privacy Policy before using our services.

12.4. Personal information relating to Students, particularly children, will only be processed where there is a lawful basis for doing so.

12.5. Customers must not share another person's personal information with Bright Bee Tutors unless they are authorised to do so.

 

13. Intellectual Property and Learning Materials

13.1. Tutors may provide lesson materials, notes, worksheets, presentations and other educational resources during tutoring.

13.2. Unless otherwise stated, such materials remain the intellectual property of the Tutor or the relevant rights holder.

13.3. Customers and Students may use materials provided to them for their own personal educational purposes.

13.4. Materials must not be commercially reproduced, distributed, sold or publicly uploaded without appropriate permission.

13.5. Nothing in these Terms prevents a Student from using their own work or notes created during a lesson for their education.

 

14. Complaints and Concerns

14.1. We want Customers and Students to feel able to raise concerns or make a complaint at any stage.

14.2.  Complaints should be submitted in writing by email or WhatsApp to Bright Bee Tutors. Where possible, the complaint should include details of the concern, the date(s) on which the issue occurred, the person(s) involved and any relevant information or evidence.

14.3.  Customers are encouraged to provide any appropriate supporting evidence that may assist Bright Bee Tutors in investigating the complaint. This may include screenshots, messages, recordings, photographs, documents or other relevant information. Bright Bee Tutors may request further information or evidence where reasonably necessary to investigate a complaint.

14.4.  Complaints and concerns received by Bright Bee Tutors will be recorded and kept securely for the purposes of investigating and managing the complaint and, where applicable, in accordance with our Data Protection and Privacy Policy.

14.5.  Bright Bee Tutors will investigate complaints fairly and proportionately, taking into account the information and evidence available to us.

14.6. Safeguarding concerns should be reported immediately and should not be delayed while a standard complaint is being investigated. Safeguarding concerns will be handled in accordance with our Safeguarding and Child Protection Policy.

14.7. Bright Bee Tutors will aim to communicate the outcome of a complaint within a reasonable timeframe. Where a complaint requires further investigation, we may inform the Customer of any relevant delay.

15. Ending a Tutoring Arrangement

15.1. The Customer may end an ongoing tutoring arrangement in accordance with the Cancellation & Rescheduling Policy and any applicable notice requirements.

15.2. Bright Bee Tutors may suspend or terminate a tutoring arrangement where there is a serious breach of these Terms, a safeguarding concern, non-payment, inappropriate behaviour or another legitimate reason.

15.3. A Tutor may also cease providing tutoring services subject to the terms of their agreement with Bright Bee Tutors.

15.4. Where a tutoring arrangement ends, any outstanding payments for lessons already provided remain payable.

15.5. Where the Customer has paid in advance for lessons that have not been provided, Bright Bee Tutors will deal with any applicable refund in accordance with the Cancellation & Rescheduling Policy and applicable law.

 

16. Availability and Technical Issues

16.1. Bright Bee Tutors will make reasonable efforts to facilitate the provision of tutoring services but cannot guarantee that online platforms, websites or internet services will always be available without interruption.

16.2. Customers are responsible for their own internet connection, device, software and equipment.

16.3. Where a technical problem prevents a lesson from being delivered, the Tutor and Bright Bee Tutors will make reasonable efforts to resolve the issue or rearrange the lesson where appropriate.

16.4. Bright Bee Tutors will not be responsible for technical failures caused by equipment, software or internet services outside our reasonable control.

 

17. Our Liability

17.1. Nothing in these Terms excludes or limits liability where doing so would be unlawful.

17.2. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited.

17.3. Subject to clause 17.1, Bright Bee Tutors will not be responsible for losses arising solely from circumstances outside our reasonable control.

17.4. We do not guarantee any particular academic outcome, examination grade, university admission or other educational result.

17.5. Nothing in these Terms removes or limits the Customer's statutory rights under applicable consumer protection legislation.

17.6. Tutoring services will be provided with reasonable care and skill as required by applicable law.

 

18. Events Outside Our Reasonable Control

18.1. Bright Bee Tutors will not be responsible for failure or delay in providing services where this is caused by circumstances outside our reasonable control.

18.2. Such circumstances may include serious illness, technical failures, internet outages, changes to online platforms, natural disasters, government action or other circumstances that could not reasonably have been prevented.

18.3. Where such circumstances occur, we will make reasonable efforts to minimise disruption and rearrange affected lessons where appropriate.

 

19. Changes to These Terms

19.1. We may update these Terms from time to time to reflect changes to our services, legal requirements or business practices.

19.2. The most recent version will be published on our website.

19.3. Where a change materially affects an existing tutoring arrangement, we will provide reasonable notice where required.

19.4. Changes will not remove or reduce rights that the Customer has under applicable law.

 

20. Entire Agreement

20.1. These Terms, together with the policies referred to within them and any specific written arrangements agreed with the Customer, form the agreement governing the provision of Bright Bee Tutors' services.

20.2. If there is a conflict between these Terms and a specific written agreement made with the Customer, the specific agreement will apply to the extent of the conflict.

 

21. Governing Law

21.1. These Terms and any dispute or claim arising from them shall be governed by the law of England and Wales.

21.2. Nothing in this clause affects any mandatory consumer rights or protections that apply to the Customer.
